Release of Liability & Assumption of Risk Agreement

This Release of Liability and Assumption of Risk Agreement (“Agreement”) is entered into between you and 20 Second Relief, Inc. (“Company”) in connection with your use of the 20 Second Relief Platform.

1. Assumption of Risk

I understand that participation in movement, stretching, and exercise programs offered through the Platform involves inherent risks, including but not limited to muscle strains, sprains, joint injuries, falls, and, in rare cases, more serious injury. I voluntarily choose to participate in these activities, and I assume full responsibility for any risks, injuries, or damages, known or unknown, that I might incur as a result of participating.

2. Release of Claims

In consideration for being permitted to use the Platform, I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, and discharge 20 Second Relief, Inc. and its officers, directors, employees, contractors, and agents (the “Released Parties”) from any and all claims, demands, or causes of action arising out of ordinary negligence in connection with my use of the Platform. This release does not apply to claims arising from the Released Parties' gross negligence, recklessness, or willful misconduct, which cannot be released under California law.

3. Health Representation

I represent that I have completed the Health Screening Form accurately and that, to the best of my knowledge, I have no medical condition that would prevent my safe participation, or that I have consulted my physician and received clearance to participate.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in Platform activities, to the extent caused by my own acts or omissions.

5. Acknowledgment

I have read this Agreement, I understand its terms, and I accept it voluntarily and with full knowledge of its significance. I understand this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of California, and that if any portion is held invalid, the remainder will continue in full force and effect.

6. Electronic Acceptance

This Agreement is presented and accepted electronically within the 20 Second Relief app, as its own acceptance step separate from the general Terms of Service. Before you can access the Platform, you will be required to review the full text of this Agreement and click “I Agree”, which will only become available after you have scrolled through or expanded the complete text. Clicking “I Agree” constitutes your electronic signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the California Uniform Electronic Transactions Act (UETA), and has the same legal effect as a handwritten signature.

20 Second Relief, Inc. will retain a record of your acceptance, including the date, time, your account identifier, and the specific version of this Agreement you agreed to.
